, there is a defense called the insanity defense which never works as most of us know because we don't recognize it. should we recognize it, that's an interesting question. should we have a more robust concept of diminished responsibility in light of the understanding that some people have less control over their preferences and desires or should we have better sentencing schemes or get rid of incarceration and come up with different models of trying to deal with punishment once we understand people have wrong selections. i think those are all interesting questions, but is there free will? well, the fact that almost everybody in the audience raised either their right or left hand contemplated it and were quickly able to act and respond. that to me says, yes, there is. now what do we want to do about it? now that we understand that those of us in the audience or up here that like chocolate cake may not have control over it, how do we want to account for that if at all in the criminal justice system? to date, we haven't. in the future, we may wish to. >> i agree with that. i think that, first of all,

plaintive. the plaintiff may not be a professional plaintiff. that does not make any difference. the defense has been tried in court. is a civil rights statute. -- it is a civil rights statute. they can be a perfectly legitimate plaintiffs to bring a lawsuit, and there are a number of people who belong to disability organizations that actually, that is what their livelihood is, bringing these lawsuits. the gentleman over here, who was also a lawyer knows of at least one case involving two lawsuits. they started all neighborhoods. the target places like san francisco because this is an old city with old buildings, virtually none of which comply. we only have new construction that would be billed to 1988 compliance standards, usually. whatever kind of business you have, the building part does not enforce ada compliance. you have your architect look at the ada if you are going to make a major revision anyway. is very expensive to do that. the demand letter is a requirment for the state -- is a requirement for the state laws to be brought. for civil rights cases, you are expected to know the law

weapons, we think it is likely the supreme court will uphold these provisions. in defense of those who do seem confused about the nature of our second amendment rights, the supreme court has not done a great job of clarifying what is the scope of our second amendment rights. as most of you know, in 2008, the supreme court held that the second amendment protects the right of individuals to have guns for personal protection. two years after that case, it struck down a lot in washington, d.c., that banned handguns and made it unlawful for you to use a shotgun or rifle for self-defense. two years after that the supreme court held the second amendment similarly applied to state and local governments and effectively declared chicago's ban on handguns unconstitutional. advocates make it clear exactly how the courts should go about interpreting the second amendment and applying it to other gun-control laws. it is one thing to identify a right in the constitution, but where the rubber hits the road is figuring out which laws are constitutional and which laws are unconstitutional, so they asked the

the child was acting in self-defense. the father was jeff hall. he was asleep when officials his ten-year-old shot him at point blank range. they say the dad was abusive and violent and it was acceptable to kill people that are a threat. but the judge found the boy knew right from wrong at the time of the shooting. judge, this is a tough one. >> it's always tough when you have facts like this. the father was the stepfather whose political views are unacceptable and preached violence and apparently caused him to practice violence on the boy at home. the standard self-defense case show you that have to be immediate threat for loss of life to justify the use of deadly force. hardly the case when the father is asleep. the fall back defense the child was so abused, so accustomed to violence he thought it was appropriate to strike back. the testimony just didn't support that because it showed not the need to strike back but the planning and plotting. so the third line of defense was he is 12 years old, he doesn't know right from wrong and planning and plotting showed that he did know right
